Consumer AI, business AI and API access: the privacy terms are not interchangeable.

Teams reach for the same AI assistant on a personal login and on a company account, and assume the data handling carries over. Inside a single brand, whether your inputs train the model, and how long they are retained, changes with the plan you are on.

This is a sourced comparison of OpenAI and Anthropic across four plan types: consumer, business or team, enterprise and API. Where a vendor’s public pages did not fully confirm a detail, the gap is stated plainly.

The two questions that decide most of it.

For business data, two questions settle the bulk of the risk. First, is what you type used to train or improve the model. Second, how long the provider keeps it, and whether you can reach zero retention. Every plan below is run through those two questions, with the vendor’s page beside each answer.

Does ChatGPT use my data to train its models?

On the consumer service (Free, Plus, Pro), your inputs may be used to improve the model unless you opt out. Under OpenAI’s Business Terms, which cover the API, ChatGPT Enterprise and ChatGPT Business, OpenAI states it will not use Customer Content to develop or improve the services by default.

Does Claude train on my conversations?

On Anthropic’s consumer plans (Free, Pro, Max), your chats are used to improve Claude only if you choose to allow it; the setting stays off until you switch it on. On the commercial products (Team, Enterprise, API), the default is no training unless you submit feedback or otherwise opt in.

How long is my data kept?

On OpenAI’s API, abuse-monitoring logs are generated for all API usage and kept for up to 30 days by default, unless longer retention is required by law; Zero Data Retention and Modified Abuse Monitoring exclude customer content from those logs. That 30-day figure describes the logs, not everything you keep. Objects you create on stateful endpoints (files, threads, vector stores) remain until you delete them, and are removed 30 days after deletion. Retention on ChatGPT Business and Enterprise depends on plan settings; confirm it for your workspace. OpenAI’s consumer service removes deleted chats within 30 days, with exceptions for de-identified data and security or legal holds.

Can I get zero data retention?

Both vendors offer a zero-data-retention arrangement on parts of the API. This is where honesty matters. OpenAI confirms availability for eligible endpoints; the exact retention period under zero data retention, as distinct from the 30-day standard, was not confirmed from the public pages. Anthropic describes not storing prompts or responses after the response is returned, while noting that flagged or legally required data can still be retained; the exact wording, exceptions and durations were not fully confirmed.

The safe reading: confirm zero retention in writing for your exact plan and endpoint. A plan name on its own does not establish it.

Which plan should a business use for client data?

On the confirmed evidence, business and commercial tiers state no training on your content by default, which shifts the risk compared with consumer tiers. That reading rests on the confirmed claims only. Legal advice is a separate matter, and retention still has to be confirmed per plan. Run the test below before the next upload.

The buyer test: run this before your next upload.

  1. Open your data controls. In ChatGPT: Settings, then Data Controls; check whether “improve the model for everyone” is on. In Claude: Settings, then Privacy; check the “help improve Claude” choice. Record the current setting.
  2. Decide whether the account you are about to paste client data into is a consumer account or a business, enterprise or API account. The defaults differ.
  3. If you need zero retention, ask the vendor in writing: is zero data retention available for this exact plan and endpoint, and what is the retention period under it. Keep the written answer.
  4. Compare your findings against the table above. Note any gap between what the plan name implies and what the terms say.
  5. Re-run at the recheck date, 19 November 2026, or when the vendor updates its terms.

What this does not settle.

This comparison covers training use and retention on the pages reviewed. It does not cover enterprise audit logging, subprocessor lists, regional storage or contract-specific terms, and it does not evaluate any product.
